ThriftyTeeHub operates an online platform that empowers users to design and sell their personalized T-shirts and merchandise. We enforce strict contractual guidelines preventing users from creating or selling items that infringe upon the intellectual property rights of third parties, encompassing copyright, trademark, and related rights. If you suspect a user on the ThriftyTeeHub service has violated your intellectual property rights, we encourage you to contact us through the procedure outlined below.

A. Reporting Intellectual Property Infringement:

  1. Identification of Infringed Material:
    • Clearly specify the copyrighted work or intellectual property alleged to be infringed, including relevant registration numbers.
  2. Description of Infringing Content:
    • Provide a detailed account of how the material in question uses the copyrighted work or intellectual property, including where it is located within the ThriftyTeeHub Service.
  3. Your Contact Information:
    • Include your full name, mailing address, telephone number, and email address.
  4. Good Faith Belief Statement:
    • Affirm that you believe the disputed use is not authorized by the copyright holder, its agents, or the law.
  5. Statement Under Penalty of Perjury:
    • Confirm the accuracy of the information provided, asserting that you are the rights holder or authorized to act on their behalf.
  6. Signature:
    • Furnish an electronic or physical signature.

B. Handling of Infringement Notifications:

Upon receiving a valid infringement notice, ThriftyTeeHub will:

  1. Remove or disable access to the allegedly infringing content.
  2. Notify the member responsible for the content removal.
  3. Terminate access for repeat offenders.

C. Procedure to Supply a Counter-Notice to the Designated Agent:

Should a notified member believe that the removed content is non-infringing, they may submit a counter-notice with the following:

  1. Identification of Removed Content:
    • Describe the removed material and its previous location within the ThriftyTeeHub Service.
  2. Good Faith Belief Statement:
    • Assert that the removal resulted from a mistake or misidentification.
  3. Your Contact Information:
    • Include your full name, mailing address, telephone number, and email address.
  4. Consent to Jurisdiction:
    • Agree to the jurisdiction of the Federal Court.
  5. Signature:
    • Provide an electronic or physical signature.

If a counter-notice is received, ThriftyTeeHub may send a copy to the original complainant, notifying them of the potential replacement or cessation of content in 10 business days. Unless the rights owner pursues legal action, content restoration may occur within 10 to 14 business days or more after receiving the counter-notice, at ThriftyTeeHub’s discretion.

Please be aware that knowingly misrepresenting content or activity as infringing may lead to liability under Section 512(f) of the DMCA, including damages and attorney’s fees.
